1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the Foqus mobile application and related services (collectively, the “App”).
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
Foqus is designed as an AI-powered trading journal. It helps you record, organise, and analyse your own trading activity and behaviour. It does not execute trades, act as a broker, or provide personalised investment advice.
2. Who we are and how to contact us
In these Terms, “Foqus”, “we”, “us”, and “our” refer to the operator of the App.

3. Eligibility and age requirement
The App is intended only for individuals who are at least 18 years old and who have the legal capacity to enter into a binding agreement.
By using the App, you confirm that you:
- are at least 18 years of age; and
- have the full legal capacity to enter into these Terms.
If you do not meet these requirements, you must not use the App.
4. Account registration and security
To use certain features of the App, you may need to create an account and provide an email address and other information.
When you create an account, you agree to:
- provide accurate, current, and complete information; and
- keep your login credentials secure and not share them with third parties.
You are responsible for all activity that occurs under your account. If you believe that your account or credentials have been compromised, you should notify us as soon as possible at contacts@foqus.pro.
5. Use of the App
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable licence to download, install, and use the App on devices that you own or control, solely for your own personal or internal business use.
You agree that you will not:
- copy, modify, or create derivative works of the App;
- reverse engineer, decompile, or attempt to extract the source code;
- use the App for any unlawful, fraudulent, or harmful purpose, or to infringe the rights of others;
- attempt to gain unauthorised access to the App, our systems, or other users’ accounts;
- use any automated means (such as bots or scrapers) to access or interact with the App, except as explicitly permitted;
- interfere with or disrupt the normal operation of the App or any related systems.
We may, at our sole discretion, update, modify, or remove features in the App from time to time.
6. Trading and risk disclaimer
The App is a tool for journaling and analysing your trading activity. It does not provide investment, financial, legal, tax, or other professional advice, and it does not constitute an offer or recommendation to buy or sell any financial instrument.
You understand and agree that:
- all trading decisions are made by you, at your own risk, based on your own assessment;
- past performance, metrics, or patterns displayed by the App do not guarantee future results;
- trading in financial instruments (including derivatives and digital assets) involves a high level of risk, including the risk of losing all of your capital;
- you should consider your own financial situation and, where appropriate, seek independent professional advice.
You remain solely responsible for all trades you place with any broker, exchange, or platform, even if you use information, insights, or summaries generated by the App.
7. Exchange connections and API keys
The App may allow you to connect to exchanges or other trading platforms by providing read-only API keys or public keys, in order to import trade history or other data.
You are responsible for:
- generating and managing your API keys on the relevant platform;
- ensuring that any keys used with the App are restricted to read-only access and do not allow trading, transfers, or withdrawals;
- revoking keys if you no longer wish to connect that platform to Foqus.
We strongly recommend that you never provide API keys with trading or withdrawal permissions to the App or to any third party.
We are not responsible for any loss, damage, or unauthorised activity resulting from your misuse of API keys or from security incidents on third party platforms (such as your exchange, broker, or wallet provider).
8. AI-based features
The App may use artificial intelligence (“AI”) to generate summaries, insights, or other content based on your trading data and notes.
You understand that:
- AI-generated outputs are probabilistic and may be incomplete, inaccurate, or not suitable for your particular situation;
- AI outputs are provided for informational purposes only and should not be relied upon as financial, legal, or professional advice;
- you remain responsible for reviewing and interpreting AI-generated content in light of your own goals, risk tolerance, and judgment.
We may use third-party AI providers to process data necessary to generate insights, as described in our Privacy Policy. We aim to minimise the amount of personal data processed and avoid including direct identifiers where possible.
9. Third-party services and links
The App may integrate with or contain links to third-party services, such as exchanges, brokers, analytics tools, messaging apps (for example, Telegram), or cloud providers.
These third-party services are not under our control, and we are not responsible for their content, terms, or privacy practices. Your use of third-party services is subject to their own terms and policies.
We do not endorse or assume any responsibility for third-party websites, products, or services, even if they are referenced or linked within the App.
10. Fees and paid features
Some features of the App may be offered free of charge, while others may be subject to fees (for example, subscription plans or premium functionality).
If we introduce paid features, we will provide clear information about the applicable prices, billing terms, and cancellation options before you are charged. Any such terms will form part of these Terms once you agree to them.
We reserve the right to change pricing, introduce new paid features, or run free trials from time to time. Changes will not retroactively affect fees already paid for a current billing period.
11. Intellectual property
The App, including its design, user interface, software, logos, trademarks, and content (excluding your own data), is protected by intellectual property laws and belongs to Foqus or its licensors.
You do not acquire any ownership rights in the App or its content by using it. You may not use our trademarks, branding, or name in a way that suggests an endorsement or affiliation without our prior written consent.
You retain all rights to the data that you enter into the App (such as your trades, notes, and tags), subject to the limited licence granted to us in the Privacy Policy to process that data to provide and improve the service.
12. Termination and suspension
You may stop using the App at any time and, where available, you may delete your account and data via in-app settings.
We may suspend or terminate your access to the App, or to specific features, if we reasonably believe that:
- you have materially breached these Terms;
- your account is being used for unlawful or fraudulent activity;
- such action is necessary to protect the App, our users, or third parties;
- we decide to discontinue the App or a substantial part of its functionality.
Where appropriate, we will try to give you reasonable notice before terminating or significantly limiting access, unless immediate action is required (for example, in case of security issues or abuse).
13. Disclaimers
The App is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or free from harmful components, or that any defects will be corrected.
We do not warrant the accuracy, completeness, or usefulness of any data, metrics, or insights generated by the App (including AI-generated content). You are responsible for evaluating any information provided and for how you use it.
14. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, consequential, incidental, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the App.
In any case where our liability is not excluded by law, our total aggregate liability arising out of or relating to the App or these Terms will be limited to the amount, if any, that you have paid to us for the use of the App in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law (for example, liability for gross negligence, fraud, or certain consumer rights in the EU/EEA).
15. Your responsibilities and indemnity
You are responsible for your use of the App and for any content or data you choose to input or connect to it.
To the extent permitted by law, you agree to indemnify and hold Foqus harmless from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of:
- your breach of these Terms; or
- your misuse of the App or violation of applicable laws or rights of others.
16. Changes to the App and to these Terms
We may update or modify the App from time to time, for example by adding or removing features, improving performance, or correcting issues.
We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page, and, where appropriate, notify you in the App or by email.
If you continue to use the App after the updated Terms become effective, you will be deemed to have accepted the changes. If you do not agree to the updated Terms, you should stop using the App and, where applicable, delete your account.
17. Governing law
These Terms are subject to any mandatory consumer protection rules that apply in your country of residence.
To the extent permitted by law, and unless otherwise required by mandatory local law, these Terms and any dispute arising out of or in connection with them or the App will be governed by and construed in accordance with the laws applicable to the operator of Foqus, without regard to conflict of law principles.
Before resorting to formal legal action, we encourage you to contact us so that we can attempt to resolve the matter informally.
